conditions of quotation / order
cost variation - estimates are based on the current costs of production
and are subject to amendment by quickprint (south west) limited on
or at any time after acceptance to meet any rise or fall in such
costs, providing the client has been informed
v.a.t. - quickprint shall be entitled to charge the amount of
any v.a.t. payable whether or not included in the quotation or
invoice
preliminary work - work carried out, whether experimentally or
otherwise, at customer’s request will be charged
proofs - author’s corrections, including alterations in
style and the cost of additional proofs necessitated by such corrections
will be charged extra. proofs of all work may be submitted for
customer’s approval, and in that event no responsibility
will be accepted for any errors in them not corrected by the author
delay / suspended - should work be suspended at the request of
or delayed through any default of the customer for a period of
30 days quickprint (south west) limited shall then be entitled
to payment for work already carried out and materials specially
ordered
variations in quantity - every endeavour will be made to deliver
the correct quantity ordered but quotations are conditional upon
margins of 10 per cent for overs or shortage
variations in quality - where a quotation has been given against
copy/layout/design submitted and the final copy is more extensive
in the amount of typesetting or more complicated in layout, we
shall be entitled to revise the quotation accordingly after letting
the client know any extra costs involved. if this delays a dated
job extra time will be added to the delivery
cancellation of order - customers wishing to cancel an order must
please do so in writing. instructions to cancel will not be accepted
verbally. any work carried out up to receipt of written cancellation
will be chargeable
courier service
- customers should inform quickprint (south west)
limited as soon as possible verbally and then followed up
in writing within 4
days of non-delivery of all or part of an order
- if on delivery,
the order is signed for and is subsequently found to be damaged
or missing part of the order please inform
quickprint (south west) limited as soon as possible verbally
liability
- completion dates or delivery dates mentioned in any quotation,
order or elsewhere are approximate only and not of any
contractual effect and quickprint (south west) limited shall
not be liable
for indirect loss or third party claims occasioned by delay
in completing the work or for any loss to the customer arising
from
delay in transit
- metal, film and other materials used by quickprint
(south west) limited in the production of a customer's order
shall remain the
property of quickprint (south west) limited
- artwork comprising
line or photographic illustrations, borders and text matter
prepared by us remains the property of quickprint
(south west) limited
customer’s property - customer’s property and all
property supplied to quickprint (south west) limited by or on behalf
of the customer will be held, worked on, and carried at customer’s
risk
material supplied by customer
- quickprint (south west) limited may
reject any paper, plates or other materials supplied or specified
by the customer which
appear to be unsuitable before or during production
- where materials
are so supplied or specified, responsibility for defective
work will not be accepted by quickprint (south
west) limited unless this is caused by failure to use
reasonable skill
and care.
- quantities of materials supplied shall be adequate
to cover normal spoilage
payment - payment of invoices shall be made on collection/delivery
unless otherwise agreed. credit payment terms are strictly nett
and are clearly shown on the front of the invoice, if the amount
is not paid by the due date quickprint (south west) limited reserve
the right to take any action necessary to collect the outstanding
debt
interest - if payment is not received in full when due, the customer
shall pay interest on the unpaid amount at a rate per annum which
is 5% above barclays bank plc base lending rate from time to time
acceptance of an order
- a signature is not required to verify an
order, verbal acceptance is sufficient
- once an order for printing
material has been accepted the customer becomes legally bound
to pay for the goods whether they
are collected
or not. the basic tax point will be the date the goods
are available for collection
deposit - a 50% deposit is required when all orders are placed
unless prior agreement has been arranged or the customer has an
established credit account
general lien - without prejudice to other remedies, quickprint
(south west) limited shall in respect of all unpaid debts due from
the customer have a general lien on all goods and property in his
possession (whether worked on or not) and shall be entitled on
the expiration of 14 days’ notice to dispose of such goods
or property as he thinks fit and to apply any proceeds towards
such debts
illegal matter
- quickprint (south west) limited shall not be required
to print any matter which in his opinion is or may be of
an illegal or
libellous nature
- quickprint (south west) limited shall be indemnified
by the customer in respect of any claims, costs and expenses
arising out
of any libellous matter printed for the customer or any
infringement of copyright, patent or design
force majeure - every effort will be made to carry out the contract
but its due performance is subject to cancellation by the printer
or to such variation as he may find necessary as a result of inability
to secure labour, materials or as a result of any act of god, war,
strike, lockout or other labour dispute, fire, flood, drought,
legislation or other cause (whether of the foregoing class or not)
beyond quickprint (south west) limited’s control
law - these conditions and all other express terms of the contract
shall be governed and construed in accordance with the laws of
england
conditions - quickprint (south west) limited reserve the right
to amend or modify the above terms and conditions at any time
